A hipossuficiência jurídica do trabalhador rural da Agricultura Familiar.

Abstract

This research begins with the perception of the reality lived in the fields by the rural workers of the family agriculture, activity that responds significantly by the food that arrives until our tables. In Brazil, due mainly to agribusiness, this worker and his family still do not have access to legal information about their rights and duties. The Federal Constitution of 1988 brought about isonomy for urban and rural workers, but the infraconstitutional legislation that regulates the theme, arises only from 2006. This legislation, added to others that have been in force since 1964 and reflects a reality of differences , although it determines the creation of opportunities for rural working life. In this aspect, the present work has the scope to present this reality and to point out educational possibilities of insertion of legal knowledge, in order to bring up the question of the legal hypnosuficiencia of this worker, aiming at healing it and, thus, approaching it principle of equality to all proposed by the Major Law of our country. With a theoretical foundation based on two pillars, the research was based on a juridical view of the legislation that touches the theme and also on aspects that involve education for these social actors. The management of the work sought to achieve the main objective proposed, which was to verify the existence of legal assumption of the rural worker in family agriculture and, in the wake of the development of this, to achieve the specific objectives, which were: analyze the legal / legal knowledge of these workers, so that, once this hypothesis is confirmed, it can determine its causes and their possible consequences. Thus, after reviewing the literature and the proposed theoretical framework, it was possible to observe, from the perspective of the defined methodology, that the research should be carried out on three fronts: farmers, teachers and students in the final phase of the Agronomy course. It is a basic research, with universal interests that hold true information. Once all phases have been completed, the present answers come from the data collected. Regarding the results, these confirm the existence of hypo sufficiency and it was possible to realize that education can have means of changing this framework of hyposufficiency, providing specific knowledge within the needs of these workers
