dc.description.resumoO aumento da demanda por energia e a crescente concentração geopolítica de reservas de petróleo e gás nas mãos de um pequeno número de países geram preocupações com a segurança energética. Esta pressão acarretou a busca por novas tecnologias para a extração do gás de folhelho nos Estados Unidos, que levaram o país a produzir, em 2011, 95% do gás consumido internamente, podendo se tornar autossuficiente em poucos anos. Tal perspectiva atraiu a atenção de outros países com possível ocorrência de gás de folhelho, como a China, a Argentina, Reino Unido e o Brasil, que em 2013 realizou o primeiro leilão, através da ANP com foco em gás natural e interesse em gás não convencional. À luz deste cenário, este trabalho teve como objetivo dar subsídios à tomada de decisão e à construção de um marco regulatório relacionado à explotação de gás em questão através da técnica de fraturamento hidráulico no Brasil, para tal, buscou-se na literatura existente principalmente dos Estados Unidos, os impactos socioambientais desta exploração descritos em artigos científicos, revistas não científicas, relatórios da indústria e órgãos governamentais e não governamentais. A extração do gás de folhelho requer a estimulação dos poços através da técnica de fraturamento hidráulico, técnica controversa, dados os seus possíveis impactos ambientais. Diante disso, os Estados Unidos flexibilizaram a legislação ambiental do país para possibilitar a produção em larga escala, e este fato tem trazido impactos aos recursos hídricos e contaminação de solo e ar impactando diretamente a saúde dos cidadãos de áreas próximas. Além disso, esta atividade afeta a biodiversidade local através do desmatamento, fragmentação de habitat, introdução de espécies exóticas, erosão, sedimentação e alterações físico-químicas de corpos d’água. Ademais, a comunidade que recebe tais empreendimentos também está sujeita a impactos sociais. Áreas rurais americanas experimentam crescimentos rápidos levando a casos de “rompimento da comunidade” e conflitos entre vizinhos, onde um enriquece pelo arredamento de suas terras e royalties recebidos e outro arca com os impactos ambientais. Considerando os riscos mencionados, alguns países decretaram a moratória para o fraturamento hidráulico como a França, a Escócia e o estado americano de Nova York. Nenhum dos países/estados pesquisados possui legislação vigente que seja abrangente o suficiente para proteger a sociedade e o meio ambiente dos potenciais impactos. Uma combinação dessas legislações associadas à regulamentação da ANP no Brasil poderia ser um começo. O país tem pouco dos aspectos que levaram os Estados Unidos ao grande sucesso econômico do gás de folhelho, e provavelmente não veria o mesmo benefício nos locais onde a produção é esperada, locais remotos, sem infraestrutura e mão de obra escassa. Concluiu-se então, que para que empreendimentos dessa magnitude ocorram com segurança é necessário que avaliações de impacto ambiental e social sejam feitas levando em consideração os impactos cumulativos, típicos desta atividade. Para isto, é importante que dados de referência sejam coletados por no mínimo dois anos e que as partes interessadas sejam envolvidas desde o início.por
dc.description.abstractIncreasing demand for energy and the growing geopolitical concentration of oil and gas reserves in the hand of a small numbers of coutries raise concerns about energy security. This pressure led to a search for new technologies for the extraction of shale gas in the United States, which allowed the country to produce, in 2011, 95% of the gas consumed domestically, with the possibility of becoming self-sufficient in a few years. This perspective has attracted the attention of other countries with shale gas reserves, such as China, Argentina, United Kingdom and Brazil, which in 2013 held the first bid, through the ANP focusing on natural gas and with interest in unconventional gas. In light of this scenario, this study aims to provide subsidies for decision-making and the construction of a regulatory framework related to gas exploitation using the hydraulic fracturing technique in Brazil, for this, the existing literature mainly from the United States was used to identify the social and environmental impacts of this operation described in scientific articles, non-scientific journals, industry reports, governmental and non-governmental organization documents. The extraction of shale gas requires stimulation of wells using the hydraulic fracturing technique, controversial technique, given its potential environmental impacts. Therefore, the U.S. eased the environmental legislation of the country to enable large-scale production, and this fact has brought impacts to water resources, soil and contamination that directly impacted the health of citizens in the surroundings. Moreover, this activity affects local biodiversity through deforestation, habitat fragmentation, introduction of exotic species, erosion, sedimentation and physical-chemical changes of water bodies. In addition, the community receiving gas projects is also subject to social impacts. American rural areas are experiencing rapid growth leading to cases of "community disruption" and conflicts between neighbors, where one gets rich by leasing their lands and received royalties and other bears the environmental impacts. Considering these risks, some countries have enacted a moratorium on hydraulic fracturing as France, Scotland and the U.S. state of New York. None of the countries/states surveyed had existing legislation that is comprehensive enough to protect society and the environment of the potential impacts. A combination of these laws associated with the existing ANP regulation in Brazil could be a start. The country has few of the aspects that led the United States to great economic success of shale gas, and probably would not see the same benefit in places where production is expected, remote locations without infrastructure and scarce labor. It was therefore concluded, that for projects of this magnitude to occur safely requires that environmental and social impact studies are made taking into account cumulative impacts, typical of this activity. For this, it is important that baseline data is collected for at least two years and that stakeholders are involved from the very beginning.eng
